1. Acceptance of Terms

By accessing the Dev Sky Solar website, booking an Annual Maintenance Contract (AMC), purchasing any standalone add-on services, or initiating a new solar installation, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these operational guidelines, you must not use our services.

2. Service Framework & Execution

We provide specialized solar maintenance, cleaning, and technical inspection services based on the plan selected by the user. The following conditions apply:

  • Plan Limits: Services are strictly limited to the number of visits and features outlined in your chosen subscription plan. Exhausted limits will require standalone add-on purchases.
  • Capacity Calculations: All base prices on our platform for AMC are calculated for systems up to 3kW. Systems exceeding this capacity are subject to incremental per-kW charges, automatically calculated at checkout.
  • Service Availability: We aim to fulfill maintenance requests promptly. However, service execution is subject to weather conditions, site accessibility, and operational bandwidth.

3. User Obligations

To ensure absolute precision in our service delivery, the client agrees to the following responsibilities:

  • Accurate Data: You must provide the correct system capacity (kW) during checkout. If our engineers discover a discrepancy onsite, a supplementary invoice will be issued for the difference.
  • Site Access: You must ensure our technical team has safe, unrestricted access to your roof/solar installation area during scheduled visits.
  • Water & Electricity: For cleaning procedures, the client must provide access to a standard water connection and basic electrical output near the installation site.

4. Financial Terms & Refund Policy

Our pricing architecture is designed for total transparency. Please review our strict payment and refund protocols below:

  • For New Solar Installations:
    • Order Confirmation: A minimum advance payment of 70% is required to confirm and initiate your solar installation order.
    • Final Settlement: The remaining 30% payment (bringing the total to 100%) must be cleared completely prior to the final installation and commissioning of the system.
    • No Return Policy: Once the solar panels, inverters, and related hardware are delivered to your site, the goods are strictly non-returnable and non-replaceable.
  • For AMC (Annual Maintenance Contracts) & Services:
    • Post-Service Non-Refundable: Once the first maintenance or cleaning service has been executed under an active AMC, the subscription fee becomes completely non-refundable.
    • Pre-Service Cancellation: If you request a cancellation before any service visit has been made, a 5% processing charge will be deducted, and the remaining balance will be refunded.
    • Add-ons: All standalone Optional Add-on services are strictly 100% non-refundable once booked.
    • Service Unavailability: In the rare event that Dev Sky Solar is unable to fulfill or provide the requested service in your area, a full 100% refund will be issued to you without any deductions.

5. Limitations of Liability

While Dev Sky Solar operates with tier-1 precision, there are external variables outside our control. We shall not be held liable for:

  • Pre-existing hardware failures, micro-cracks, or inverter malfunctions that occurred prior to our maintenance visits.
  • Performance drops caused by localized grid failures, extreme weather events (hail, cyclones), or third-party electrical modifications.
  • Damage to roof tiles or structures that are inherently weak, aged, or structurally compromised prior to our engineers accessing the site.

6. Termination of Contract

We reserve the right to terminate or suspend your AMC without a refund if we determine that the client has provided fraudulent system details, engaged in abusive behavior towards our engineers, or breached these Terms and Conditions.

7. Governing Jurisdiction

These operational terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts located in our operational headquarters' district.
